Article 1.
Conditions of Membership.
Membership is acquired at the time of registration (payment of the registration fee).
The first month's registration is payable by: Cash or credit card.
The months of direct debit membership start with the first direct debit payment or credit card recurring payments and are indefinite, and in case of suspension it will be notified before the 20th of the month prior to the month of cancellation in writing with the cancellation/freezing form.
Sports drink with a limited amount are included in the membership.
Article 2. Registration.
1. Memberships shall be paid between the 1st and 5th of each month by direct debit, credit card recurring or cash payments. The month's registration fee must be paid together with the Welcome Pack.
2. When a monthly direct debit is returned and its collection is not possible,
Q-FITLIFE will penalize and add to your gym fee an additional fee of €2 on the invoice the following month.* (refund costs)
3. To cancel or freeze your bank payment (direct debit o credit card recurring payment), in any case, it will always be necessary to fill in the cancellation/freezing form before the 20th day prior to the month you wish to cancel or freeze. The form is available at reception.
4 . The cancellation or freezing of the direct debit before the stipulated time can only be effected: for any illness or injury with medical certificate or change of address when the member moves to another location futher than 20km from QFITLIFE Mijas. If the illness or change of address occurs during the contract, it is compulsory to present the corresponding certificate or contract for the cancellation of the contract.
The cancellation will be effective once the person concerned brings the cancellation/freezing form to Q-FITLIFE. This is a necessary and indispensable condition, both before the minimum period (1 month or 3 months) and afterwards.
In case of freezing the contract (due to work or injury) the months of non-attendance will be recovered for the direct debit once the contract has been restarted.
5. To cancel or freeze your direct debit, in any case, it will always be necessary to bring the cancellation/freezing form before the 20th day prior to the month you want to cancel or freeze.
Article 3.
Terms of Payment.
All members shall pay in advance. Each fee will be charged monthly from the 1st to the 5th of each month. Q-FITLIFE Mijas will not issue refunds.
Article 4.
Change of Prices
Q-FITLIFE Mijas will always give reasonable notice of changes in fees so that the member is informed.
Article 5.
Illness, Injury or Serious Condition.
A member may temporarily stop in case of injury, illness or serious condition. The minimum period of lay-off shall be one month.
Article 6.
Responsibilities.
The member declares, under his/her responsibility, that his/her state of health is optimal and allows him/her to practice the sports activities proposed by the gym, as well as to use the services, materials and facilities once he/she is aware of the rules of safety, hygiene and the use of each space. In this sense, the member declares that he/she does not suffer from any illness that prevents him/her from practicing sport and in particular, the activities and services offered by Q-FITLIFE Mijas. The member acknowledges that he/she has been informed and is aware of the risks associated with the practice of sports activities at Q-FITLIFE Mijas. Members and their guests will make proper use, at their own responsibility and risk, of the facilities of our center. Q-FITLIFE Mijas is not responsible for the suffering of an injury, loss, damage to equipment or theft of personal belongings. In case of breakage of any material, due to misuse, the company may claim it from the person concerned.
The use of towels is obligatory.
The use of lockers is strictly limited to the duration of each session. The member is obliged to have their own padlock to lock their locker, which remains their property at all times. The locker used by the member is provided as a free loan for the duration of each session. It is strictly forbidden to leave personal belongings in the locker once you have left the center.
With the exception of internal staff, personal training is not permitted within the facilities.
Article 7.
Conditions of Access to Q-FITLIFE Mijas.
Access to the gym will be by means of a membership card. The use of the card is personal.
Minors under 18 years of age who wish to register must be accompanied by a legal representative at Q-FITLIFE Mijas. In this case, registration can only be done in person. The legal representative of the minor must prove his/her status by means of the corresponding legal documentation. Both will sign the subscription and the Contract. The legal representative will make the payment in place of the minor and in his/her name and must sign an authorization for the minor to practice the activities subscribed in the same.
Article 8.
Control and supervision.
For your safety and that of all subscribers.
Q-FITLIFE Mijas has video surveillance 24 hours a day, seven days a week. The information thus obtained is subject to the applicable regulations on the protection of personal data and is stored for a maximum of 30 days, after which it will be automatically deleted by the computer management system, unless there is an ongoing police investigation.
Article 9.
Refusal of entry.
If a participant contravenes our rules, wears inappropriate clothing, has inadequate hygiene, misuses the facilities or causes public nuisance, this may be sufficient reason for Q-FITLIFE Mijas staff to refuse entry and/or immediately terminate the participant's contractual relationship with Q-FITLIFE Mijas.
For the aforementioned reasons and without prejudice to the participant's relation to his total contribution and in express agreement with the subscribed period, he shall fully comply with his financial obligation.
Article 10
Confidentiality and professional secrecy
The parties undertake to transmit to each other the information necessary to comply with legal obligations and to allow the best possible performance of the service.
The parties undertake not to disclose to third parties any information declared confidential by both parties without express consent.
The parties undertake to keep the relationship regulated in this contract, as well as the information and/or documentation exchanged within the framework of the execution of this contract, under strict confidentiality, with the exception of information of a public nature, expressly assuming the obligation not to reproduce, disclose or publish it by any means, in whole or in part, either directly or through third parties, or to make any use of it other than that related to the object of this contract.
The provisions relating to confidentiality contained in this clause shall have a duration of 5 years from the termination, for any reason, of the contract; or in the event that the parties agree to the destruction of the documentation.Article 10. Applicable law and competent jurisdiction
This contract shall be governed by and construed in accordance with Spanish law. For any action or procedure derived from or in relation to this contract, the parties submit to the jurisdiction and competence of the Courts of Baza, expressly waiving any other jurisdiction that may correspond to them.
Article 11.
Data protection.
You declare that you have been informed that your personal data and, where appropriate, those of the members of your organization, have been incorporated into the files and management of Q-FITLIFE Mijas, for the fulfillment of your obligations with the administration and management of Q-FITLIFE Mijas, for the fulfillment of your obligations with the public administrations, as well as the commercial or contractual relations that may be entered into and you give your consent. You also declare that you have been informed that you can exercise your rights of access, rectification, cancellation and opposition, against the File Manager at the following address CL ANTEQUERA SN, BAZA 18800 (GRANADA).
